SUBMISSIONS

All information submitted to Citigroup via this site shall be deemed and remain the property of Citigroup and Citigroup shall be free to use, for any purpose, any idea, concepts, know-how or techniques contained in information a visitor to this site provides Citigroup through this site. Citigroup shall not be subject to any obligations of confidentiality regarding submitted information except as agreed by Citibank or as otherwise specifically agreed or required by law. Nothing contained in these terms and conditions will be construed as limiting or reducing Citibank’s responsibilities and obligations to customers in accordance with Citigroup or Citibank’s privacy policies.

CITI MOBILE^®SERVICE TERMS OF USE

The following are the Terms of Use for the Citi Mobile service, including the software application that is compatible for use on (i) the iPhone mobile device or iPod touch mobile device, and/or (ii) a mobile device operating on the AndroidTM operating system, which is offered by Citibank. These Terms of Use shall apply to any person (referred to herein as "you" or "your") who accesses or uses any feature of Citi Mobile or downloads the Citi Mobile software application and by doing so, hereby agrees to the Citi Mobile Service Terms of Use.

Citi Mobile service is available to every customer of Citibank with an activated Citibank^® Debit and/or ATM Card and/or consumer Credit Card ("Card"), a compatible wireless web-enabled cell phone or other type of mobile device ("Eligible Mobile Device") and a User ID that provides accounts access online and via Citi Mobile service. You can enroll to obtain account information and make selected transactions using your Eligible Mobile Device. The list of Eligible Mobile Devices is published at Citibank^® Online or this website and is subject to change with adequate prior notice. There is no charge for using the Citi Mobile service unless otherwise notified. Regular account charges (if any) will apply to services and features that are accessible through the Citi Mobile service. The telecommunications carrier for your Eligible Mobile Device may impose an extra fee in order to make such device ’wireless web enabled’.

You are granted a non-exclusive, non-sublicensable, non-transferable, personal, limited license to install and use the Citi Mobile application ("Mobile Software") only on a mobile device that you own or control, solely for your personal use and as expressly permitted herein. Certain Mobile Software that Citibank uses to provide the Citi Mobile service has been licensed from third parties (each a "Third Party Licensor") that is not affiliated with Citibank. This limited right to use the Mobile Software is revocable in the discretion of Citibank and/or its affiliates. Citibank, its affiliates and its Third Party Licensors retain all right, title and interest in and to the Citi Mobile application and any modifications and updates thereto. You agree not to decompile or reverse engineer the Mobile Software. All rights not expressly granted to you herein are reserved.

Transactions initiated using the Citi Mobile service may constitute electronic funds transfers under the Malaysian laws and regulations. Please review the section of the Citibank Account Terms and Conditions relating to lost or stolen Citibank Debit and ATM Cards, the Citibank Credit Card Terms and Conditions relating to lost or stolen Credit Cards or the specific terms and conditions governing a payment card (including a physical, digital or virtual card), contactless device or other device (including a code of account number to be used for a transaction) issued by Citibank to you, as well as unauthorized electronic transactions for important information on your rights and responsibilities when making transactions using Citi Mobile. Instructions for reporting unauthorized transactions are contained on this website under Online Security Tips. You may only receive information about the accounts that are linked to your Card and/or make transfers between the accounts that are linked to your Citibank Debit and ATM Card. You may only make bill payments to payees added into your payee list, for example, JomPay payee list or to other payees that you set up in your account previously. The standard limitations on transfers and bill payments apply to transactions made through Citi Mobile, as more fully explained in this website.

The Citi Mobile service is provided "as is" and without warranty. You acknowledge and agree that from time to time, the Citi Mobile service may be delayed, interrupted or disrupted for an indeterminate period of time due to circumstances beyond the reasonable control of Citibank including, without limitation, any inaccuracy, interruption or delay in transmission by the telecommunications carrier used with the Eligible Mobile Device to access the wireless web, or any interruption, disruption or failure in the provision of the service, whether caused by strikes, power failures, equipment malfunctions or other reasons. Citibank, its affiliates or a Third Party Licensor shall not be liable for any claim arising from or related to the Citi Mobile service arising from any such delay, interruption, disruption or similar failure. To the fullest extent permitted by law, in no event will Citibank or any affiliate or Third Party Licensor be liable for indirect, consequential or special damages, including lost profits, arising from your use of the Citi Mobile service, even if such damages were reasonably foreseeable and notice was given regarding them. These limitations will apply to all causes of action, whether arising from breach of contract, tort or otherwise. Any such losses or damages that Citibank is liable for will be limited to direct damages only.

By identifying a cell phone or other device as an Eligible Mobile Device for use with the Citi Mobile service, Citibank does not recommend, endorse or make any representation or warranty of any kind regarding the performance or operation of such device. You are responsible for the selection of an Eligible Mobile Device and for all issues relating to the operation, performance and costs associated with such device with your telecommunications carrier.
Citibank and its Third-Party Licensors have no obligation to correct any bugs, defects or errors in the Citi Mobile service or software, or to otherwise support, maintain, improve, modify, upgrade, update or enhance the Citi Mobile service or Mobile Software. Citibank may terminate your use of the Citi Mobile service and expand, reduce or suspend the type and/or dollar amounts of transactions allowed using the service, change the enrollment process and transaction limits associated with it from time to time based on security issues and other factors at any time in its discretion with adequate prior notice.

You acknowledge and agree that Citibank may collect, transmit, store, and use technical, location, and login or other personal data and related information, including but not limited to technical information about your device, system and application software, and peripherals, and information regarding your location, that is gathered periodically to facilitate the provision of Mobile Software updates, product support, and other services to you (if any) related to, or in connection with, the Citi Mobile service.

You agree that you will not use the Citi Mobile application or any services related thereto for any purposes prohibited by Malaysian laws and shall not use or otherwise import, export or re-export the Mobile Software, except as authorized by United States of America laws, Malaysian laws, the laws of the jurisdiction in which the Mobile Software was obtained and any other applicable laws where you may be subject to. You hereby represent and warrant (i) you are not located in a country that is subject to a U.S. Government, Malaysian Government or any other governments’ embargo, or has been designated by the U.S. Government, Malaysian Government and/or any other governments as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government, Malaysian Government and/or any other governments’ list of prohibited or restricted parties.

This Citi Mobile Service Terms of Use agreement is governed by the laws of Malaysia and you hereby irrevocably submit to the jurisdiction of the courts in Malaysia.

APPLE SPECIFIC TERMS AND CONDITIONS

In addition to your agreement with the foregoing terms and conditions, you acknowledge and agree to the following provisions with respect to your use of the version of the licensed Citi Mobile application compatible with an iPhone or iPod touch device (also called the "Licensed Application").

This Citi Mobile Service Terms of Use is an agreement between you and Citibank. Apple Inc. ("Apple") is not a party to the Citi Mobile Service Terms of Use agreement and does not own and is not responsible for the Licensed Application. Apple is not providing any warranty for the Licensed Application, except if applicable, to refund the purchase price for it. Apple is not responsible for maintenance or other support services for the Licensed Application and shall not be responsible for any other claims, losses, liabilities, damages, costs or expenses with respect to the Licensed Application, including, without limitation, any third party product liability claims, claims that the Licensed Application fails to conform to any applicable legal or regulatory requirement, claims arising under consumer protection or similar legislation, and claims with respect to intellectual property infringement. Any inquiries or complaints relating to the use of the Licensed Application, including those pertaining to intellectual property rights, must be directed to Citibank at the address provided in the 'Contact Us' section of this website.

The license you have been granted herein is limited to a non-transferable license to use the Licensed Application on any iPhone or iPod touch that you own or control, as permitted by the Usage Rules set forth in the App Store for Malaysia Terms and Conditions. In addition, you agree to comply with the terms of any third party agreement that is applicable to you when using the Licensed your application, such as your wireless data service agreement.

You hereby represent and warrant (i) you are not located in a country that is subject to a U.S. Government, Malaysian Government or any other governments' embargo, or has been designated by the U.S. Government, Malaysian Government and/or any other governments as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government, Malaysian Government and/or any other governments' list of prohibited or restricted parties.

You acknowledge and agree that Apple and Apple's subsidiaries are third party beneficiaries of this Citi Mobile Service Terms of Use agreement and that, upon your acceptance of the terms and conditions of this Citi Mobile Service Terms of Use agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Citi Mobile Service Terms of Use agreement against you as a third party beneficiary thereof.

ADDITIONAL TERMS

Certain sections or pages on this site may contain separate terms and conditions, which are in addition to these terms and conditions. In the event of a conflict, the additional terms and conditions will govern for those sections or pages.

GOVERNING LAW

Use of this site shall be governed by all applicable laws and regulations of Malaysia and you hereby irrevocably submit to the jurisdiction of the courts in Malaysia.
